Private Company & Government Agency Disclaimer
BUnited Services is not the Federal Motor Carrier Safety Administration (FMCSA), United States Department of Transportation (USDOT), Internal Revenue Service (IRS), Unified Carrier Registration Plan, or any other federal, state, or local government agency.
Clients may be able to complete certain registrations, filings, or government transactions directly with the appropriate government agency without purchasing third-party assistance from BUnited Services.
Fees charged by BUnited Services are fees for professional assistance, preparation, processing, compliance support, administration, monitoring, or related services unless expressly identified as a government or third-party fee.
Client Responsibilities
Clients are responsible for:
- Providing accurate, complete, and current information.
- Providing requested documents and authorizations in a timely manner.
- Reviewing information submitted on their behalf for accuracy.
- Maintaining valid operating authority, insurance, registrations, licenses, permits, and other requirements applicable to their operation.
- Monitoring communications from BUnited Services, government agencies, testing facilities, and other applicable third parties.
- Notifying BUnited Services when company, driver, vehicle, ownership, contact, or operating information changes when such information affects a service provided by BUnited Services.
- Complying with all applicable federal, state, and local laws and regulations.
BUnited Services is not responsible for errors, delays, noncompliance, penalties, missed deadlines, or other consequences caused by inaccurate, incomplete, outdated, or untimely information provided by the client.
Fees, Payments & Recurring Billing
Fees are disclosed through the applicable checkout page, subscription, invoice, proposal, application, service agreement, or other purchasing method.
Recurring Payment Authorization
Monthly subscriptions automatically renew and are billed monthly unless canceled. Annual subscriptions automatically renew and are billed annually when the purchased plan is designated as an automatically renewing annual subscription, unless canceled.
By enrolling in a recurring service, you acknowledge that recurring charges may be processed without requiring you to manually approve each individual renewal transaction.
Tier-Based Pricing
Certain BUnited Services subscriptions are priced according to fleet size, driver count, equipment count, service level, or another usage-based tier.
The client is responsible for selecting or providing accurate information regarding the applicable tier. If the applicable driver, vehicle, equipment, or service count changes, the subscription may need to be moved to the appropriate pricing tier. Any pricing adjustment will be handled subject to applicable notice and authorization requirements.
Failed Payments
Clients are responsible for maintaining a valid payment method. Failed or declined payments may result in interruption, suspension, or termination of services until the account is brought current.
Service Initiation
Unless otherwise stated, BUnited Services may begin work immediately after an order or payment is confirmed. This may include reviewing information, creating accounts, initiating compliance work, preparing filings, ordering third-party services, or beginning administrative processing.
Cancellation & Refund Policy
Cancellation requests for recurring services should be submitted in writing before the next scheduled renewal date.
Cancellation of a recurring subscription stops future renewal charges after the cancellation becomes effective. Cancellation does not automatically result in a refund of charges already processed or amounts attributable to services already provided, initiated, ordered, prepared, or submitted.
Except where otherwise required by law or expressly agreed to in writing by BUnited Services, purchases are final once services have been initiated, filings have been prepared or submitted, third-party expenses have been incurred, testing or reports have been ordered, or access to purchased services has been provided.
If you believe a charge was made in error or have a billing concern, please contact BUnited Services promptly so the matter can be reviewed.
Nothing in these Terms limits any consumer or payment rights that cannot lawfully be waived.
Government & Third-Party Processing
Certain BUnited Services require interaction with government agencies, laboratories, medical providers, background screening providers, payment processors, insurance providers, technology platforms, or other independent third parties.
BUnited Services cannot guarantee government or third-party approval, activation, processing times, system availability, or decisions.
Completion or submission of a filing by BUnited Services does not mean that the receiving agency has approved, activated, or completed processing of that filing.
Clients remain responsible for responding to requests from government agencies and third parties when their direct participation, identity verification, signature, authorization, payment, or documentation is required.
Compliance Management & Monitoring Services
BUnited Services may provide document management, compliance monitoring, reminders, alerts, file organization, portal access, or similar ongoing compliance support.
These services are designed to assist carriers with managing their compliance responsibilities. They do not transfer the motor carrier's legal or regulatory responsibilities to BUnited Services.
Clients are responsible for submitting or uploading complete, accurate, legible, and current documentation and for replacing documents when they expire or change.
Automated reminders, expiration alerts, missing-document notifications, and other system-generated notices are compliance support tools and should not be relied upon as the client's sole method of determining regulatory compliance.
Vehicle Compliance Management
Vehicle Compliance Management may include access to a vehicle compliance system, onboarding assistance, vehicle record organization, document storage, expiration tracking, reminders, and other features included in the client's selected plan.
Unless the client's purchased service expressly states otherwise, the client is responsible for uploading and maintaining vehicle documents within the system, including applicable registrations, insurance documentation, inspection records, maintenance documentation, and other records.
BUnited Services is not responsible for a missing, expired, inaccurate, or outdated document that was not timely provided or uploaded by the client.
Vehicle Compliance Management pricing may be based on equipment or fleet size. Clients must notify BUnited Services of material changes to the number of vehicles or equipment covered by their subscription.
Driver & Drug and Alcohol Compliance Services
Driver Qualification File, Drug and Alcohol Consortium, testing, Clearinghouse, and related services are limited to the services included in the client's selected package or subscription.
Clients are responsible for notifying BUnited Services when drivers are hired, removed, change status, or otherwise require compliance action.
Services or testing not included in a subscription may require an additional fee. Enrollment in one compliance service does not automatically mean that every DOT or FMCSA compliance requirement applicable to the carrier is included.
Electronic Communications & Authorizations
By providing an email address or telephone number in connection with a service, clients consent to receive service-related communications from BUnited Services through appropriate electronic channels.
Electronic signatures, online acknowledgments, checkbox acceptances, submitted applications, and other electronic authorizations may be used to document a client's instructions, consent, or agreement where legally permitted.
Clients are responsible for maintaining accurate contact information and reviewing communications related to their services.
Confidentiality & Data
BUnited Services will handle client information in accordance with its Privacy Policy and applicable legal requirements.
Information may be shared with government agencies, laboratories, service providers, technology vendors, or other third parties when reasonably necessary to provide a purchased service, comply with client instructions, or satisfy legal requirements.
BUnited Services may also disclose information when required by law, court order, subpoena, or other lawful process.
Dispatching Services
Freight dispatching services, when purchased, may be governed by a separate dispatch agreement. If a separate written dispatch agreement applies, that agreement controls with respect to the specific dispatching services addressed by it.
BUnited Services is not a motor carrier or freight broker solely by virtue of providing dispatching services and is not responsible for cargo claims, accidents, carrier operations, broker payment disputes, or the carrier's performance of transportation services, except to the extent otherwise expressly agreed in writing.
No Guarantee of Regulatory Compliance
BUnited Services provides compliance assistance, administrative support, monitoring, and related services based on the scope purchased by the client.
Because regulatory compliance depends on the carrier's operation, conduct, records, drivers, vehicles, timely disclosures, and other factors outside BUnited Services' control, BUnited Services does not guarantee that use of a particular service will prevent every violation, fine, audit finding, enforcement action, or other regulatory consequence.
Limitation of Liability
To the fullest extent permitted by applicable law, BUnited Services will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of its services.
BUnited Services is not responsible for delays, losses, penalties, or damages resulting from client error, failure to provide required information, government or third-party processing, system outages, regulatory actions, or circumstances outside BUnited Services' reasonable control.
To the fullest extent permitted by applicable law, BUnited Services' aggregate liability arising from a specific purchased service will not exceed the amount paid to BUnited Services for the specific service giving rise to the claim.
Suspension & Termination
BUnited Services may suspend or terminate services for nonpayment, misuse of services, failure to provide required information, unlawful activity, material breach of these Terms, or other circumstances that reasonably prevent BUnited Services from continuing to provide the service.
Termination does not eliminate payment obligations or other responsibilities incurred before termination.
Intellectual Property
BUnited Services' website content, branding, proprietary forms, training materials, written materials, processes, graphics, and other proprietary content may not be copied, reproduced, sold, republished, or distributed without authorization, except as permitted by law or expressly authorized in writing.
Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles, except where applicable federal law or another controlling law requires otherwise.
Changes to These Terms
BUnited Services may update these Terms from time to time. Updated Terms will be posted on this page with a revised "Last Updated" date.
Changes will apply prospectively as required by applicable law. Material changes affecting existing recurring services will be handled in accordance with applicable notice and consent requirements.
